プロジェクト概要	This study confronts the fundamental misconception that democracy most naturally promotes social justice. Strangely in Asia, populist democracy in politics actually fosters elite aggrandizement in markets. Conversely, social justice finds support in counter-majoritarian constitutional norms insulated from democratic majorities. That is because in Asian cultures, normative discourse is weak and serves only as a thin veneer for raw power and naked interests.

プロジェクト概要	The project is a research paper that will look into and capture the dynamics and fervor at work on ‘Ijtihad’ (In Islam: reasoning on matters related to Islamic Law and how it applies in the changing conditions of society) that provided platform for Indonesia, Malaysia and Thailand in a new reading of the Islamic prescriptions to promote Women Human Rights. It will look into the dynamics behind the practice of customary laws that actually interpreted and adapted the Islamic prescriptions to local cultures. Using the above-mentioned as platforms, the research will provide new readings of the Islamic prescriptions and the customary laws to raise the prevailing practices at par with international law and standard, particularly on women human rights.
